Privacy Policy

1°) Introduction

This Privacy Policy outlines how arnaudbalme.com (“We”, “Us”, or “Our”) collects, uses, maintains, and discloses information collected from users (each, a “User”) of our website and associated services.

2°) Information Collection

We may collect personal identification information from Users in various ways, including, but not limited to, when Users visit our site, register for a service, subscribe to a newsletter, fill out a form, and in connection with other activities, services, features, or resources we make available on our Site. Users may be asked for, as appropriate, name, email address, mailing address, phone number.

3°) Information from Social Networking Sites

Our Service may include interfaces allowing connection to social networking sites (SNS). By connecting to a SNS through our Site, you authorize us to access, use, and store information based on your settings on that SNS in accordance with this Policy.

4°) Use of Information

The information we collect may be used to personalize user experience, improve our Site, improve customer service, process transactions, send periodic emails, or manage a contest, promotion, survey or other site feature.

Suchinformation is collectively called the “Billing Information.” Billing Information is collectedand processed by our third-party payment processors operating as our agents (see, OnwardTransfers to Third Parties). We do not directly obtain or process any Billing Informationunless you speak directly to an account or sales personnel. We do not directly processpayment card information but rely on third-party payment processors.

9°) Email Opt-Out and Disabling Cookies

You may opt out of promotional emails and manage cookie preferences through your browser settings.

10°) Third Party Websites

Users may find advertising or other content on our Site that link to the sites and services ofour partners, suppliers, advertisers, sponsors, licensors, and other third parties. We do notcontrol the content or links that appear on these sites and are not responsible for thepractices employed by websites linked to or from our Site. In addition, these sites orservices, including their content and links, may be constantly changing. These sites andservices may have their own privacy policies and customer service policies. Browsing andinteraction on any other website, including websites which have a link to our Site, is subjectto that website’s own terms and policies.

11°) Children’s Information

Our Site and Services are not intended for children under 18. We do not knowingly collect information from children under this age.

We take steps to protect Personal Information but cannot guarantee complete security.

Rights. If you are a California resident, you have the right to request information from us regarding the manner in which we share certain categories of personal information with third parties for their direct marketing purposes, in addition to the rights set forth above. Note that fulfillment ofthe request may not ensure complete or comprehensive removal (e.g., if the content orinformation has been reposted by other individual).

Also, please note that we have not yet developed a response to browser “Do Not Track” signals, and do not change any of our data collection practices when we receive such signals. We will continue to evaluate potential responses to “Do Not Track” signals in light of industry developments or legal changes.

Rights. If you are located in the EU or Switzerland, you have certain rights with respect to your Personal Information. Following is a summary of those rights and additional information applicable to our collection and use of your Personal Information.

If you are located in the EU, the personal informationwe collect may be stored and processed in any country in which we or our affiliates,suppliers, third party electronic payment processors and/or financial institutions or agentsmaintain facilities, including, but not limited to, the United States of America. YOU CONSENTTO ANY AND ALL PERSONAL INFORMATION YOU PROVIDE AND SUBMIT VIA THE SITE ANDSERVICES BEING SENT TO THE UNITED STATES OF AMERICA. The United States of Americahas not sought nor received a finding of “adequacy” from the EU under Article 45 of theGDPR. We rely on derogations for specific situations as set forth in Article 49 of the GDPR.YOU ARE ALSO INFORMED THAT THE UNITED STATES OF AMERICA PRESENTLY DOES NOTHAVE AN ADEQUATE LEVEL OF PERSONAL DATA PROTECTION AS DETERMINED BY THEEUROPEAN COMMISSION’S ADEQUACY DECISION ON OCTOBER 6, 2015 (CASE C-362/14)AND ARTICULATED IN THE EUROPEAN UNION’S GENERAL DATA PROTECTION REGULATIONAND HAS NOT RECEIVED A SIMILAR DESIGNATION OF ADEQUACY BY ANY OTHER FOREIGNDATA PROTECTION AUTHORITY. YOU AGREE TO THE TRANSFER OF YOUR DATA ANDPERSONAL INFORMATION TO THE UNITED STATES OF AMERICA, HOWEVER, TO BE USED INACCORDANCE WITH THIS PRIVACY POLICY.
  • F. Obligations to Data Protection Authorities (DPAs) We will respond diligently and appropriately to requests from DPAs about this policy orcompliance with applicable data protection privacy laws and regulations. We will, uponrequest, provide DPAs with names and contact details of the individuals designated tohandle this process. With regard to transfers of Personal Information, we will (1) cooperatewith inquiries from the DPA responsible for the entity exporting the data and (2) respect itsdecisions, consistent with applicable law and due process rights. With regard to transfers ofdata to third parties, we will comply with DPAs’ decisions

14°) EU-U.S. and Swiss-U.S. Privacy Shield.

On July 16, 2020, the Court of Justice of the European Union issued a judgment declaring as“invalid” the European Commission’s Decision (EU) 2016/1250 of July 12, 2016 on theadequacy of the protection provided by the EU-U.S. Privacy Shield. As a result of thatdecision, the EU-U.S. Privacy Shield Framework is no longer a valid mechanism to complywith EU data protection requirements when transferring personal data from the EU to theUnited States of America.On September 8, 2020, the Swiss Data Protection Authority, the Federal Data ProtectionCommissioner (“FDPIC”), announced that it no longer considers the Swiss-U.S. Privacy Shieldadequate for purposes of transfers of personal data from Switzerland to the United States ofAmerica. As a result of that announcement, the Swiss-U.S. Privacy Shield is no longer a validmechanism to comply with Swiss data protection requirements when transferring personaldata from Switzerland to the United States of America.Despite the invalidation of the EU-U.S. Privacy Shield and the Swiss-U.S. Privacy Shield, Weremain committed to adhering to applicable Privacy Shield Principles with respect toPersonal Information transferred from the EU or Switzerland to the United States ofAmerica as further described below.If you are providing your information from the EU or Switzerland, We complie with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework as set forth bythe U.S. Department of Commerce regarding the collection, use, and retention of personaldata transferred from the EU and Switzerland to the United States. We have certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is anyconflict between the terms in this Privacy Policy and the Privacy Shield Principles, thePrivacy Shield Principles shall govern. To learn more about the Privacy Shield program, thePrivacy Shield Principles and to view our certification, pleasevisit https://www.privacyshield.gov/.
